Part V of the Arbitration Act deals with international commercial arbitration. This Part incorporates into Maltese Law, the UNCITRAL Model Law on International Commercial Arbitration, which is a well-known and tested legal regime which has been adopted in many countries around the world.
Furthermore, the provisions contained in Part X of the Arbitration Rules, 2004 also apply to international arbitration cases, which provisions shall continue to apply until such time as rules under the Arbitration Act are promulgated specifically for international arbitration.
The Second and Third Schedules to the Arbitration Act are also of importance in the field of international commercial arbitration in Malta. Theses Schedules contain the Geneva Protocol on Arbitration Clauses (Second Schedule to the Act), the Geneva Convention on the Execution of Foreign Arbitral Awards (Second Schedule to the Act), the UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards (Second Schedule to the Act) and the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (Third Schedule to the Act).
